Ex parte Smith: Judge Nathaniel Pope delivered his opinion that the Boggs affidavit, upon which Missouri's extradition requisition was based, was fatally defective in that it was vague, contained conclusions of law, and presented insufficient facts to show that Smith was a fugitive from Missouri law. Pope therefore discharged Smith.
