Joseph Smith as mayor fined Augustine Spencer for assaulting his brother Orson Spencer. Charles A. Foster, Robert D. Foster, and Chauncey L. Higbee were also fined for resisting marshal John Greene while he was arresting Augustine Spencer on Joseph Smith's orders. Higbee and Charles Foster were also fined for threatening Joseph Smith with a pistol at the mayor's office. When the pistol was seized by Joseph Smith and Joseph Coolidge, Robert D. Foster tried to interfere. Because Charles Foster was restrained and jailed, he sued Joseph Smith, Joseph Coolidge, and John Greene.
